These are the promises both ways: what 4everbe keeps, and what we ask of you. They apply to everyone who uses 4everbe.com: the family who keep a memorial, the helpers they invite, and the visitors who leave a memory. Three shorter agreements sit under these Terms and are part of them: the family agreement, the visitor's agreement and the helper's agreement. Where they overlap, these Terms win.

1. What you are buying

One memorial for one person, paid once. The launch price is $49 USD. The full price is $99 USD, and the launch price runs [until DATE / for the first N memorials]. Tax is added where the law requires it. There is no subscription and nothing more to pay for the memorial itself.

A memorial holds 2 GB after we have prepared what you upload for the screen: about two hours of video, and all the photos and letters a family is likely to keep. Videos are short, two or three minutes, five at the very most, and are served at 720p. If a memorial ever fills up, another 2 GB can be bought for $29, once each time.

When you pay, a code comes by email. The code is used once, never expires, and can be found again from the email address that paid. The code starts one memorial.

2. For as long as we operate

We keep the memorial for as long as 4everbe operates. Two promises back that:

The owner and every admin can download the whole memorial, every original, every prepared copy and every record, at any time, in one file, at no cost. This right never ends.

If 4everbe ever had to close, we give at least six months' written notice to every owner and admin, the download stays open throughout, and greetings still sealed are released to the people the author named. Nothing is deleted before the six months have run.

3. Refunds

Thirty days, no questions. Write to support@4everbe.com within thirty days of paying and the fee comes back, whatever was paid. This sits beside your rights under the Consumer Guarantees Act 1993 in New Zealand and the consumer law of the country you live in, which these Terms do not take away.

The owner may close a memorial for good at any time by writing to us. We offer the download first, then it is gone. A memorial made in bad faith, for someone who has not died and did not ask for it, or for someone who never existed, is removed without a refund.

4. Who may keep a memorial, and the roles

A memorial is kept by family, or by someone close to the family with the family's agreement, as the family agreement says. A person may also keep a memorial for their own life while they are here. You must be eighteen or older to pay.

The person who starts the memorial is its owner. The owner may invite helpers with a helper link, and may make a helper an admin. An admin approves memories, changes the cover, invites helpers and changes settings. A helper adds photos and memories, and nothing a helper adds appears without an admin's word. The owner cannot be removed from the desk by anyone else. The owner may deactivate or remove a helper or an admin at any time; what that person added stays with the memorial. A helper link stays open until an admin closes it, and we remind admins from time to time to look at who can open the desk.

5. The family reads everything first

Nothing a visitor sends appears on a memorial until an admin makes it public. The family may keep a memory private or delete it, and does not edit the visitor's words. The visitor's agreement says what a visitor gives and keeps.

6. What you add, and our licence

Everything uploaded stays yours or its author's. You give 4everbe only the right to store it, prepare it for the screen (compress, convert and scan it), back it up, and show it on this memorial as the family directs. That right ends when the material or the memorial is deleted. We never sell content, never show it anywhere but the memorial, never use it for advertising, and never train any system on it.

You must hold the rights to what you upload, or have the permission of whoever made it.

7. What is not allowed, and how reports work

Nothing unlawful. Nothing that threatens, shames or targets a living person. Nothing about a child without a parent's or guardian's agreement. Nothing sexual. Nothing sold or advertised. No malware. No memorial for a living person who did not ask for it.

Every photo and every frame of every video is checked, before it is stored, against the lists of known child-abuse material. A match is quarantined at once, the memorial is paused, and we preserve the material and report it to the Department of Internal Affairs and, where the law requires, to other authorities. We will not soften this for anyone.

Every public memorial carries a report link. What is reported is hidden at once and stays hidden until a person at 4everbe has looked at it, which we do within twenty-four hours. A dismissed report restores the memory. An upheld one keeps it hidden. If a family member, or anyone with a claim, contests a whole memorial, we make it private, not deleted, and the family agreement says how it is settled.

8. Pausing a memorial

We may pause a memorial while a report is looked at, while a payment is disputed, at the family's request, or under a legal order. A paused memorial shows visitors a plain page and opens the family's desk read-only with a notice. Nothing is deleted, the owner is told the reason, and the memorial resumes when the matter is settled. We may also pause the whole site for maintenance, for a stated time, with nothing lost.

9. Memorials for the living, sealed greetings, and the day

A person may keep a memorial for their own life. It stays closed while they are here. They name at least one person who opens it one day. They may ask family and friends for memories now, and each sender chooses whether it is read now or waits for the day. They may seal greetings for days ahead: a birthday, a wedding, a date they choose.

Sealed greetings are encrypted at rest with keys held apart from the database, and every access is logged. We do not claim we cannot read them; we promise we do not, and the log shows it.

The family is in charge of the day. A family member with a login reports the passing, which opens a twenty-four-hour window. The author and every family member with a login get a one-press stop in case of a mistake. After the window, the memorial opens, the first named person becomes its owner and the others become admins, and sealed greetings are delivered as they were set. No one at 4everbe decides this; we step in only to settle a dispute.

10. Addresses, links and the log

A memorial's address is 4everbe.com/memorial/ followed by eight random characters, never a name. An invite link, a helper link and a greeting's link are doors with their own addresses; whoever holds one may use it, so share them with care. A private memorial is seen only by people with its link, and its name cannot be searched. A public memorial can be found by anyone.

Every change to a memorial is written to its log, with the name and the time. The family cannot edit the log. We keep it for a year. When someone at 4everbe opens a desk to help, that visit is in the log too, and we only look, never change.

11. Where we sell

We sell memorials in the countries listed at 4everbe.com/countries. We may stop taking new memorials from a country, or stop showing 4everbe there, if the law or the cost of operating there requires it. A memorial that already exists keeps working, and its download right stands, whatever country it is in.

12. Support

Write to us at support@4everbe.com, or from the desk with Write to us. Everything we send you about your memorial, a code, a receipt, a notice, comes through the same place, so you can always find it.

13. The parts that bind

We may change these Terms. We tell owners and admins by email at least fourteen days before a change that matters, and the desk shows the version in force. Using 4everbe after that is agreement to the change.

To the fullest extent the law allows, our liability to you is limited to the fee you paid. Nothing in these Terms limits rights that the law gives you and does not let us take away.

These Terms are governed by the laws of New Zealand, and the courts of New Zealand have jurisdiction, without taking away a consumer's right to bring a claim where they live.
